Discount Tire’s Privacy Disclosure for California Resident Job Applicants, Employees, and Contractors

This Privacy Disclosure for California Residents supplements the information contained in Discount Tire’s general Privacy Policy and applies solely to job applicants, employees, officers, directors, and contractors who reside in the State of California (collectively, “Employees/Contractors”). For all other California residents, the privacy disclosure located at https://www.discounttire.com/customer-service/ccpa-privacy-notice applies.  Any terms defined in the California Consumer Privacy Act (“CCPA”) have the same meaning when used in this notice. 

Discount Tire wants you to understand how and why we collect “Personal Information,” which includes any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular Employee/Contractor.  Employees/Contractors should have no expectation of privacy when using Discount Tire provided technology or whenever accessing Discount Tire technology resources or information.  Employees/Contractors should also review all other agreements, contracts, or terms that may apply to their relationship with Discount Tire.

Discount Tire is committed to protecting the privacy of our Employees/Contractors, and we take administrative, technical, and physical safeguards to protect your Personal Information from unauthorized access, misuse, accidental loss, and alteration.

Notice of Employee Monitoring

We may monitor telephonic and electronic conversations or transmissions, including e-mail and internet access, by Employees/Contractors conducted using our systems or devices. This includes use of systems, computers, telephones, and other devices provided or maintained by Discount Tire or by our service providers. We may monitor these devices and services to ensure their safety, security, and efficiency, and to permit internal evaluations.

Information We Collect and Sources of Personal Information

The chart below identifies the categories of Personal Information that Discount Tire has collected in the preceding 12 months and the specific purposes for which we collect each category of information.  For more detailed information regarding why we process each category of Personal Information, see the Purposes for Collection of Personal Information section below.

Please note that we may not collect all categories of Personal Information about each Employee/Contractor and the specific pieces of information that Discount Tire may have collected about any specific Employee/Contractor will differ due to the nature of the individual’s position, role, and benefits.

We collect most of the information directly from the Employee/Contractor, through the applications or forms submitted and the information provided at the time of hire.  We may collect personal information from third parties, such as information from third parties that provide accreditation, educational institutions, benefits providers, and vendors that provide background checks or related information.  Finally, we may automatically collect information as the Employee/Contractor uses our tools, systems, or resources, or when on-site at one of our locations.

Purpose for Collection of Personal Information

We may use or disclose the Personal Information we collect for one or more of the following purposes:

a. Administer the Employee/Contractor Relationship

Discount Tire needs to keep and process Personal Information for normal employment and contractor engagement purposes, including identifiers, personal information, and protected classifications.  The Personal Information we hold and process will be used for management and administrative uses and only shared with others who have a need to know such information. We will keep and use it to enable us to run the business and manage our relationship with you effectively, lawfully and appropriately, during the recruitment process, while you are working for us, and after your employment or contract has ended. This includes using Personal Information to enable us to comply with any legal requirements associated with an employee or contractor relationship, to administer payroll, to provide you with benefits, to provide training, to recruit other Employees/Contractors, to ensure your health and safety, to comply with an employment or service contract, to demonstrate our commitment to equal employment opportunity and fair employment practices, and to otherwise enable you to perform your professional obligations and responsibilities at Discount Tire. 

b. Compliance with Legal Obligations

In certain situations, we may need to collect and process your Personal Information to comply with our legal obligations. These obligations include:

  • Tracking demographic information to confirm compliance with equal opportunity and non-discrimination policies and requirements.
  • Processing information relating to your health in order to comply with our obligations under applicable employment and safety and health laws.
  • Verification of employment.
  • Tax obligations.
  • Insurance coverage and unemployment.
  • Producing information relevant to any alleged violation of law or in compliance with a subpoena or other valid legal or regulatory request.

 

c. Facilitate Communications

Discount Tire uses various tools and platforms that enable Employees/Contractors to communicate with each other and to access and share work product and other work-related materials more efficiently. 

d. Provide Benefits

Discount Tire offers Employees a variety of benefits, including benefits related to healthcare, retirement savings, and wellness programs.  In doing so, Discount Tire collects Personal Information such as identifiers, personal information, protected classifications, and employment information.  When you participate in certain benefits programs, Discount Tire may also generate a log of your activity, track internet and other network activity, and develop a user profile to provide those programs to you in a manner tailored to your preferences. 

All benefits may not be available to all Employees, and Discount Tire will only collect Personal Information to provide a benefit if the Employee is eligible for and enrolled in that benefit.  Employees should take care to read the specific terms applicable to any particular mobile application or benefits program to understand the specific pieces of information collected.

e. Ensure the Safety of Employees, Contractors, Facilities, and Property

Discount Tire collects various categories of personal information to ensure the health and safety of its Employees/Contractors, facilities, and property.  Some information, such as identifiers, personal information, and protected classifications, help verify the identity of Employees/Contractors in specific facilities, as well as help screen for indicators of infectious diseases or vaccination status of those entering facilities.  Other categories of information, such as geolocation data and sensory data, may assist Discount Tire with ensuring the security of people, facilities, and property. 

How Your Personal Information Is Disclosed

In the preceding 12 months, we have disclosed the following categories of employment related information with service providers and third parties, who are necessary for facilitating the employment relationship and providing you with benefits:

  • Identifiers
  • Personal Information Categories under Cal. Civ. Code § 1798.80(e)
  • Protected Classification Characteristics
  • Internet or Other Similar Network Activity
  • Sensory Data
  • Professional or Employment-Related Information
  • Non-Public Education Information
  • Sensitive Personal Information

 

We enter into written contracts with our service providers to ensure the privacy and security of your Personal Information.  Under these contracts, we restrict the access to and processing of your Personal Information to that which is necessary for the purpose of the disclosure.

In certain circumstances, we may provide you with opportunities to sign up for certain benefits programs that involve the disclosure of your Personal Information to third party benefits providers.  Any such program will be purely optional and based on your opt-in participation.  In such situations, you should review the third-party benefits providers’ terms and privacy policy to see how they process your information.

We do not collect, process, or disclose Sensitive Personal Information, as defined under the CCPA, for purposes other than those specified in Section 7027 of the CCPA regulations, or any employment related information regarding individuals under 16 years of age.

Sharing and Sale of Personal Information

Discount Tire may share your Personal Information with its Service Providers in order to fulfill a purpose for collecting or using that Personal Information.  Discount Tire has not sold your Personal Information for monetary consideration. Our use of cookies and other website tracking technologies may be considered a sale of personal information under the CCPA.  Categories of personal information that we have sold under the CCPA include identifiers (e.g. IP addresses) and Internet or other similar network activity. Categories of third parties to whom personal information is sold under the CCPA include data analytics providers and advertising and marketing providers.

Retention of Personal Information

Any Personal Information collected by Discount Tire will be retained by Discount Tire during the period of active employment of the Employee or service relationship of the Contractor, as well as during the post-employment period as long as the Personal Information is used to serve its original purpose or as directed by applicable legislation, regulation, or policy.  Discount Tire will ensure that all practices and procedures relating to the disposal of Personal Information will respect your privacy and will be done confidentially. 

Your Rights and Choices

The CCPA provides consumers with specific rights regarding their personal information. This section describes your rights and explains how to exercise those rights. Please note that the CCPA may contain certain limitations and exceptions may apply.

Right to Know Categorical and Specific Information

You have the right to request that Discount Tire disclose categorical and specific information to you about our collection, sale, and sharing of your personal information. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of your personal information we collected, sold, or shared.
  • The categories of sources from which your personal information we collected.
  • Our business or commercial purpose for collecting, selling, or sharing your personal information.
  • The categories of third parties to whom we disclose, sell, or share your personal information.
  • The categories of your personal information we disclosed to a recipient for a business purpose and the categories of recipients to whom it was disclosed.
  • The specific pieces of your personal information we collected.

 

 Right to Correct Inaccurate Personal Information

If Discount Tire maintains inaccurate personal information about you, you have the right to request that we correct these inaccuracies.  After receiving notice of these inaccuracies, Discount Tire will make reasonable efforts to correct your personal information throughout our systems and networks.

 Right of Deletion

You have the right to request that Discount Tire delete your personal information that we have retained, subject to certain exceptions allowed under the CCPA. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.  If an exception applies, we will not delete your personal information that falls under the exception and will only process your personal information for purposes or under circumstances allowed by the CCPA.  

 Right to Opt-Out of the Sale of Personal Information and Targeted Advertising

Consumers have the right to opt-out of the sale and sharing of your personal information as those terms are defined under the CCPA. 

We do not sell your personal information for monetary consideration.  However, our use of tracking technologies on www.discounttirefamily.com (“Website”) may be considered a “sale” or “sharing” of personal information under the CCPA and are used for purposes of targeting advertising to you. You can opt out of being tracked by these third parties and targeted advertising by clicking the “Do Not Sell my Information” link, by submitting an Opt Out privacy request, or by broadcasting the GPC signal.

Discount Tire honors and responds to the GPC signal.  Please note that when your browser broadcasts the GPC signal, we will limit the functionality of the Website and prevent the Website from transmitting your personal information to third parties. We will also treat this signal as a verified request to stop selling your personal information and stop processing your information for purposes of targeted advertising.  However, the GPC signal does not fully identify you by name or email address.  Therefore, we may not be able to honor this request for other interactions you may have or have had with Discount Tire. You may also submit an Opt Out privacy request with your email, phone number and other personal information for us to complete the opt-out process.

If you visit the Website from a different computer or device, or clear cookies on your browser that store your preferences, you will need to return to this Website to opt-out or rebroadcast the GPC signal.

 Exercising Rights

To exercise the access, correction, deletion, and opt-out rights described above, please submit a verifiable consumer request to us by either:

 

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

The CCPA may limit the number of times you may make a verifiable consumer request in a certain time period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

 

In order to verify your identify, we will ask you for personal information that only you would reasonably know. If you use an Authorized Agent to make your request, we will ask the Authorized Agent to have you fill out a form that certifies your use of an Authorized Agent and provides information related to a recent transaction you made at Discount Tire or other personal information that only you would reasonably know. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

 Right to Non-Discrimination

You have the right to not be discriminated against for exercising the privacy rights conferred by the CCPA.  We will not discriminate against you because you exercised any of your privacy rights.

 Right to Limit Use and Disclosure of Sensitive Personal Information

Discount Tire processes a limited amount of sensitive personal information, as that term is defined under the CCPA, with your consent. 

Discount Tire does not use or disclose your sensitive personal information for any purpose other than those specified in California Code of Regulations § 7027(m). 

Updates to the Privacy Disclosure

This Privacy Disclosure is subject to periodic revision.  The current version of this Privacy Disclosure will also be posted to the Knowledge Center and the Discount Tire Family website where you can review or consult the Privacy Disclosure at any time. 

Discount Tire may be subject to certain laws and regulations relating to privacy and information security in more than one jurisdiction.  If any term, covenant, condition, or provision of this Privacy Disclosure is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the intent of this Privacy Disclosure that the scope of the rights and obligations of the Privacy Disclosure be reduced only for the affected jurisdiction and only to the extent deemed necessary under the laws of the local jurisdiction to render the provision reasonable and enforceable and the remainder of the provisions of the Privacy Disclosure will in no way be affected, impaired, or invalidated as a result.
